Thanks to legal access insurance, you will have the power to stand up for your rights in a court of law without having to support all the legal expenses.

This insurance coverage is comprised of several parts:

Consultation and assistance

We offer all our insureds a legal consultation telephone service, allowing them to obtain any information necessary to the protection of their rights. For the holders of the legal access insurance, this consultation service includes the examination of documents, the transmission of formal notice of action and a support service to assist you in undertaking an action before the Small Claims Court.

Moreover, no matter the field of law, the insured can consult the lawyer or the notary of its choice and La Capitale will pay the first consultation by subject, according to the tariff set out in the contract.

Indemnity up to $5 000 in the event of guaranteed litigation

This indemnity covers lawyer fees, external expert expenses and legal costs (bailiff, court costs), according to the tariff set out in the contract.

This coverage reaches up to $15 000 per period of insurance.

The fields covered are:

• Owner and residential unit: leaking roof, hidden defects or construction defects, private nuisance
• Personal injury or property damage; slip and fall on a pavement or floor badly maintained, medical negligence
• Consumer affairs: respect of the sale contract, of the guarantees of sale and of all that was promised to you at the time of the sale or lease
• Income protection affairs: application for refund for an unjustified loss of income (C.S.S.T., S.A.A.Q., pension board, disability insurance, etc.)
• Employment: loss of job or downgrading as a result of discrimination or without justifiable cause and for which you are not represented by a trade union

Settlement of estate and opening of an adult guardianship regime

La Capitale will cover, up to a maximum of $1 000 the expenses and fees related to the settlement of the estate of any person covered under the contract, as well as the expenses and fees related to the opening of an adult guardianship regime.

Public investigation

We also cover the representation expenses of the insured as interested person, recognized as such by the coroner, in the context of a public investigation lead by the coroner.

For $46 per year, you should definitely not pass this up.

The legal access insurance is offered as a complement to an automobile or residential insurance.
From now on, you will not only have the right to protect yourself legally, you will also have the means to do so.
